ATD 2025 Partner Manager Moments Sweepstakes Official Rules

Sponsor: The Sponsor of the Partner Manager Moments sweepstakes (the "Sweepstakes") is Inscape Publishing, LLC located at Metropoint Building 400 Highway 169 S., Suite 300, Minneapolis, MN 55426 ("Sponsor").

Eligibility: The Sweepstakes is open only to Everything DiSC Authorized Partners eighteen (18) years of age or older who are legal residents in a country, state, province or territory where the Sweepstakes is compliant. Employees, officers and representatives of Sponsor and its related companies and each of their respective officers, directors, employees, shareholders, and agents (collectively, "Sweepstakes Entities"), as well as the immediate family (spouse, parents, siblings, and children) and household members of each such individual (whether related or not) are not eligible. Subject to all federal, state and local laws and regulations. For avoidance of doubt, this Sweepstakes is void in Puerto Rico, Guam, the U.S. Virgin Islands, Quebec and anywhere else otherwise prohibited by law.

Agreement to Official Rules: By participating in the Sweepstakes, each entrant unconditionally agrees to and accepts these Official Rules and the decisions of Sponsor, which are final and binding in all matters related to the Sweepstakes.

How to Enter: To enter the Sweepstakes, you must post your “Manager Moment” post (i.e. a post about a manager or leader who has made a difference in your career) on your LinkedIn profile page on the LinkedIn website, tagging 5 other individuals in your network and using all three of the following required hashtags in your post: #GreatManagers #EverythingDiSC #ATD25. Your LinkedIn post must be made on your LinkedIn profile page between May 13, 2025 at 12:01AM Eastern Time (“ET”) and May 21, 2025 at 11:59PM ET (the “Promotion Period”). 

Limit: One entry per person. Entries in excess of this limit will be void. All entries must be posted on the LinkedIn website during the Promotion Period. All entries become the exclusive property of Sweepstakes Sponsor, and none will be acknowledged or returned. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible entries, which will be disqualified. Use of any automated system to submit entries is prohibited and will result in disqualification. In the event of a dispute as to any online entry, the authorized LinkedIn account holder used to enter will be deemed to be the entrant. Potential winners may be required to show proof of being the authorized LinkedIn account holder.

Drawings: The Grand Prize Drawing will be conducted in accordance with these Official Rules within 1 week of the Promotional Period ending, on or by May 28th, 2025. The random drawing will be conducted amongst all eligible entries submitted in accordance with these Official Rules by Sponsor, whose decisions as to the administration of the Sweepstakes and the selection of potential winners are final and binding. Entrant selected must comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements. The potential winner will be notified by email. Potential winner must accept the prize within five business days of notification by email and if receipt of such email is not confirmed by Sponsor within five business days, potential winner must contact Sponsor at the telephone number indicated in the notification email. Any winner notification not responded to or returned as undeliverable may result in prize forfeiture and an alternate potential winner will be selected from the remaining eligible entries. The potential prize winner may be required to sign and return an affidavit of eligibility and liability/publicity release within 10 days of notification. If a potential winner is a Canadian resident, that person must also answer correctly a mathematical skill-testing question without the benefit of any calculating devices before the prize will be awarded. If a potential winner cannot be contacted, prize is returned as undeliverable or fails to sign and return the affidavit of eligibility and liability/publicity release within the required time period, potential winner forfeits prize. If a potential winner is disqualified for any reason, Sponsor will award his/her prize to an alternate potential winner. Only three alternate potential winners will be selected after which the prize will remain unawarded. Odds of winning depend on the number of eligible entries received.

Prizes: The Approximate Retail value (the “ARV”) of the prize is: $0 U.S. Dollars. The ARV is a good faith calculation by Sponsor of the current prize, and Sponsor confirms and agrees that there is no perceived or actual retail value of the prize. One (1) grand prize winner selected will receive a complimentary 2026 Partner Renewal.

Sponsor reserves the right to substitute a prize or prize component with another of comparable or greater value. Prizes may not be sold, bartered or transferred. Federal, state and local sales or other taxes are the sole responsibility of the Winner. All Winners receiving an individual prize with a retail value over $600.00 USD will be issued Form 1099-MISC by the Sponsor.

Publicity: Except where prohibited, participation in the Sweepstakes constitutes winner's consent to Sponsor's use of winner's name, likeness, voice, opinions, biographical information, hometown and state for promotional purposes in any media without further notice, payment or consideration.

General Conditions: Sponsor reserves the right to cancel or modify the Sweepstakes if fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity of the Sweepstakes, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the prize at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules, or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately damage any web site or undermine the legitimate operation of the Sweepstakes is a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

Release: By entering this Sweepstakes, entrant agrees to release and hold harmless, Sweepstakes Entities from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of any prize.

Limitations of Liability: Sweepstakes Entities shall have no responsibility or liability (including, but not limited to, liability for any property loss, damage, personal injury or death) in connection with: (i) participation in this Sweepstakes; (ii) human error; (iii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software, delay in operation or transmission, communications line failure, technology outage, theft or destruction or unauthorized access to, or alteration of entries, whether caused by the sender or any of the equipment or programming associated with or utilized in the Sweepstakes; (iv) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (v) unauthorized human intervention in any part of the entry process or the Sweepstakes; (vi) electronic or human error which may occur in the administration of the Sweepstakes or the processing of entries; (vii) acceptance/possession, use/misuse, and/or defects of prize or prize component; or (viii) any injury or damage to persons or property, including but not limited to entrant's computer, hardware or software, which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Sweepstakes. Entrants further agree to indemnify and hold harmless the Sweepstakes Entities from any and all liability resulting or arising from the Sweepstakes, to release all rights to bring any claim, action or proceeding against the Sweepstakes Entities.

Disputes: Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with the Sweepstakes, or any prizes awarded, other than the administration of the Sweepstakes or the determination of winners shall be resolved individually, without resort to any form of class action, and exclusively by the federal or state courts located in New York, New York; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes but in no event attorneys' fees; and (iii) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to such State's conflict of law rules.

Winners List: Sweepstakes results and a copy of these Official Rules may be obtained by sending a self-addressed, stamped envelope to Inscape Publishing, LLC located at Metropoint Building 400 Highway 169 S., Suite 300, Minneapolis, MN 55426, Attn: Erin Pisca. Requests must be within 60 days of the end of the Promotion Period.
