ELIGIBILITY AND REDEMPTION TERMS & CONDITIONS

THIS DOCUMENT CONTAINS VERY IMPORTANT INFORMATION REGARDING YOUR RIGHTS AND OBLIGATIONS, AS WELL AS CONDITIONS, LIMITATIONS, AND EXCLUSIONS THAT MIGHT APPLY TO YOU.

THE TERMS “PARTICIPANT” “YOU”, OR “YOUR”, SHALL REFER TO ANY INDIVIDUAL OR ENTITY WHO ACCEPTS THESE TERMS AND CONDITIONS.

1. ELIGIBILITY

The Wiley Everything DiSC® ATD 2026 Free, Limited-Time Everything DiSC Worksmart Trial (the “Trial”) offered by Inscape Publishing, LLC (“Wiley”) is available only to participants attending the 2026 ATD Conference & EXPO who (i) agree to these Terms and Conditions, (ii) are at least eighteen (18) years old, and (iii) are not prohibited from accessing or using the Catalyst Platform and the Workplace product by applicable law.

You agree that this Agreement shall be deemed to have been negotiated, entered into, executed and performed for all purposes within the United States of America.

Participants who are residents in jurisdictions prohibited or restricted by applicable law, are not eligible to participate in the Trial.

To be eligible to receive the Trial, each participant must visit the Everything DiSC® Booth (Booth #1817) at the 2026 Association for Talent Development (ATD) Conference & EXPO between May 17th and May 20th, complete a demo with an Everything DiSC staff member at one of the demo stations, and have its ATD badge scanned (the “Entry”) in accordance with these Terms & Conditions. The link to these Terms & Conditions will be made available at Wiley’s Everything DiSC Booth at ATD EXPO (Booth #1817). To qualify as a valid submission, the scanned badge Entry must:

  • Contain the participant’s name and email address. Participants must participate in a a live demo at the booth and have their badge scanned by a Wiley staff member at Wiley’s Everything DiSC Booth at ATD EXPO (Booth #1817) during the ATD Expo between May 17th and May 20th. All information provided within the Entry must be legible and accurate. Wiley is not responsible for delivering the Trial if the information provided on the Entry is illegible or incomplete (e.g. the name or email address cannot be read or deciphered or the email address is inactive). Failure to provide legible and accurate information will disqualify the participant from receiving the Trial.
  • The email address provided on the Entry cannot be associated with an already existing Catalyst account; a new, separate email address must be provided to receive the Trial.

By submitting the Entry, you warrant that:

  • Your Entry is original and does not infringe the intellectual property rights of any third party.
  • The email address provided on the Entry is not associated with an already existing Catalyst account. Email addresses associated with existing Catalyst accounts are not eligible for the Trial and will not receive access to the Catalyst platform or Everything DiSC Worksmart; or
  • You are eligible to participate in the Trial.

Where an Entry contains any of the above, Wiley may deem such Entry void and ineligible to receive the Trial.

2. LIMIT

Each participant may enter 1 Entry. Multiple participants are not permitted to share the same email address. Any attempt by a participant to enter more than 1 Entry by using multiple/different email addresses, identities, registrations, or any other methods shall void all Entries entered by that participant and that participant, at the sole discretion of Wiley, will not be eligible to receive the Trial.

3. LICENSE

Participant retains ownership of the copyright in any Entry. However, by submitting an Entry, participant grants Wiley, either alone or with its affiliates or licensees, the irrevocable, perpetual right to edit, adapt, and publish in any media now known or hereafter discovered any or all of the Entry, including in its products and services and any marketing or advertising related thereto without compensation to the participant, his or her successors or assigns, or any other entity. Any Entry used in such a way will be given attribution credit based on the name supplied with the Entry.

4. HOW TO REDEEM YOUR TRIAL

On or before May 22, 2026, participants who submitted an Entry will receive an email from Wiley with an access link to access Catalyst and the Everything DiSC Worksmart product (the “Product”). When entering the access link, participants must complete the Everything DiSC® assessment and create a Catalyst account in order to take advantage of the Catalyst platform and experience the Product. This limited-time access to the Catalyst platform and the Product is available from the date the participant receives the access link until June 30, 2026 (the “Access Period”), after which time access will be cut off. Upon termination of the Access Period, the participant’s Catalyst account will be deleted from Catalyst. Participants who wish to purchase a Catalyst account may contact an Everything DiSC Authorized Partner or email Wiley directly at [email protected] to learn more. Participants who experience any technical difficulties when attempting to access the Catalyst platform or during its use of the Catalyst platform during the Access Period should contact Catalyst tech support at the contact information provided at the bottom of the Catalyst page.

In addition to these Terms & Conditions, Wiley’s Terms of Use for the Catalyst Platform and the Product found at https://catalyst.everythingdisc.com/Terms will apply to Participant’s use of the Catalyst platform and the Product.

5. DISCLAIMER AND INDEMNIFICATION

By submitting an Entry for the Trial, you agree to be bound by these Terms and Conditions. Wiley assumes no responsibility for electronic hardware, programming or software malfunctions, or failures, or line connections, accessibility or availability, or technical failures of any kind, or unauthorized human intervention, or the incorrect or inaccurate capture of any submission or other information, or for the failure to capture any such information. Wiley is not responsible for: (1) any incorrect or inaccurate information; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the submission process; or (4) technical or human error which may occur in the administration of or the processing of Entries.

Participants, by submitting an Entry, hereby waive and release, and agree to defend, indemnify and hold harmless, Wiley and its parents, subsidiaries, affiliates, distributors, and all of their respective officers, directors, employees, representatives and agents, and their respective successors and assigns (the “Indemnified Parties”), from and against, any and all rights, claims and causes of action whatsoever that they may have, or which may arise, against any of them for any liability for any matter, cause or thing whatsoever, including but not limited to any injury, loss, damage, whether direct, compensatory, incidental or consequential, to person, including death and property, arising in whole or in part, directly or indirectly, from their acceptance of the access link for the Trial the use of the Catalyst platform and/or the Product, or the use of the Entry, including without limitation any claims relating to violations of the content restrictions.

You acknowledge and agree that the Indemnified Parties have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, expressed or implied, in fact or in law relative to the Catalyst platform or the Product including but not limited to quality, condition, functionality, performance, suitability, or fitness for a particular purpose. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.

6. PERSONAL INFORMATION

By submitting an Entry, you give your consent to your personal data being stored and processed by Wiley and its affiliates. Wiley, its affiliates and their authorized agents will collect, use, disclose or otherwise process the personal information provided by you as set forth in Wiley’s Privacy Policy, and in particular for the purposes of administering the participant’s Trial of the Product, recordkeeping and for compliance with Wiley’s and its affiliates legal obligations. By submitting an Entry, you understand and acknowledge that your personal information will be used for these purposes and as set forth in Wiley’s Privacy Policy. Participants have certain rights regarding Wiley’s and its affiliates processing of the participants’ personal data under certain circumstances (which may include the rights of access, portability, correction, deletion, objection and restriction). For information about participants’ rights and how to exercise them, consult Wiley’s Privacy Policy. Participants can opt to withdraw this consent at any time.

Additional terms for participants in the European Economic Area and Switzerland, Wiley is the data controller for participant’s personal information. The legal basis for Wiley’s processing of participant’s personal data relating to the Entry is (1) the performance of Wiley’s agreement with participant, including as necessary to administer the contract and for fulfillment purposes (Article 6(1)(b) of the General Data Protection Regulation (“GDPR”); (2) in compliance with applicable laws, including to satisfy mandatory recordkeeping requirements and as necessary for compliance with Wiley’s legal obligations under EU, Swiss and other laws in the jurisdictions in which Wiley makes this matter available (Article 6(1)(c) of the GDPR); (3) Wiley’s legitimate business interests (including for promotional purposes and maintaining appropriate business records (Article 6(1)(f) of the GDPR); and/or (4) as necessary to establish, protect or defend Wiley’s legal rights (such as in the event of litigation or legal claims involving the Trial (Article 6(1)(f) of the GDPR). By submitting an Entry, you acknowledge that you have read and understood Wiley’s Privacy Policy, which explains how personal information is processed. If you refuse to provide any personal data to Wiley that is marked as mandatory for the Entry, your Entry will not be valid. Your personal data will be retained for as long as necessary for the administration of the Trial and, in order to ensure that it is available in the event of a litigation or dispute, or for as long as required by applicable laws.

7. AGREEMENT TO TERMS AND CONDITIONS

By submitting an Entry, you unconditionally agree to and accept these Terms and Conditions and the decisions of Wiley, which are final and binding in all matters related to the Trial.

8. LAW AND VENUE 

Except where prohibited, participant agrees that any and all disputes, claims and causes of action arising out of or connected with this Entry shall be resolved under the laws of the State of New York, without respect to any conflict of law issues, and entrant agrees that such shall be resolved individually, without resort to any form of class action, and exclusively by the Federal and State Courts located in New York County, New York.
